Disclosing gifts to relevant entities

Relevant entities

A relevant entity is:

  • a registered political party
  • an associated entity
  • a third party.

What must be disclosed

Any person who makes gifts with an amount or value totalling more than $5,000 (indexed) to a relevant entity during a disclosure period must provide that information to the Electoral Commissioner.

This does not apply to any of the following if they make a gift to a relevant entity:

  • another relevant entity
  • a candidate in an election
  • a member of a group.

If a person makes a gift to another entity, with the intention of benefitting a particular relevant entity, the person is deemed to have made the gift directly to the particular relevant entity.

A person must also report any gifts of more than $5,000 (indexed) received by them and used wholly or partly to enable them to make gifts or reimburse them for making a gift.

The information provided must include:

  • the amount or value of the gift
  • the date on which it was made
  • the name and address of the relevant entity that received the gift
  • any other details prescribed by the regulations.

Timeframes for disclosure

A gift or donation made between the start of the disclosure period and the start of the designated period (see Glossary) must be disclosed in the following timeframes:

  • if it was made after 1 January, then it must be disclosed within 30 days of 1 July in that year
  • if it was made after 1 July, then it must be disclosed within 30 days of 1 January in the next year.

A gift made during the designated period must be disclosed by the end of the designated period (section 130ZH(7)(b) of the Electoral Act 1985).

The disclosure period starts at the end of 30 days after polling day for the last preceding general election and ends 30 days after polling day for the next general election.
